Welcome to ImmaDaddy. These Terms of Service (“Terms”) govern your use of immadaddy.com and any purchase you make from us. By using our website or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, please do not use the website.

1. Eligibility and account information

You must be at least the age of majority in your place of residence, or have the consent of a parent or guardian, to make a purchase. You agree to provide current, complete and accurate account, billing, payment and delivery information. You are responsible for keeping any account credentials secure.

2. Products

We aim to describe and display our products accurately. Colours and appearance may vary depending on your screen and settings. Product descriptions, prices and availability may change without notice. We may discontinue products or limit quantities where reasonably necessary.

3. Orders

Submitting an order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted. We may decline or cancel an order where reasonably necessary, including for suspected fraud, pricing or stock errors, or delivery restrictions. If payment has been taken for an order we cannot fulfil, we will refund the amount paid.

Our products are made to order, so we may be unable to change or cancel an order once production has begun. Please review your product, size, colour and delivery details carefully before checkout.

4. Prices, payment and promotions

Prices are shown in the currency selected for your market. Applicable taxes, shipping charges and other charges are displayed at checkout where required. Promotions may have additional terms and may be changed or withdrawn at any time, subject to applicable law.

5. Shipping and delivery

Production and delivery estimates are set out in our Shipping Policy. Delivery dates are estimates, not guarantees, and delays may occur because of carriers, customs, severe weather, peak periods or other events outside our reasonable control.

6. Returns, refunds and damaged items

Because each item is made to order, we do not offer change-of-mind returns or size exchanges. Our remedies for damaged, defective, misprinted, incorrect or lost items are explained in our Refund Policy. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law where it applies.

7. Acceptable use

You may use the website only for lawful personal or household purposes. You must not misuse the website, introduce malicious code, attempt unauthorised access, interfere with its operation, infringe another person’s rights, submit false or misleading information, or use the website for unlawful, fraudulent or abusive activity.

Our website may use or link to third-party services. Their own terms and privacy practices may apply. ImmaDaddy is powered by Shopify, but purchases from this store are made directly with ImmaDaddy. Shopify is not the seller of our products and is not responsible for fulfilling your order.

How we collect, use and disclose personal information is described in our Privacy Policy. Shopify and other service providers may process information to operate the website, payments, fulfilment, delivery and related services.

11. Disclaimers and liability

To the maximum extent permitted by law, the website is provided on an “as available” basis. We do not promise that access will always be uninterrupted, secure or error-free. To the maximum extent permitted by law, ImmaDaddy is not liable for indirect, incidental, special or consequential loss arising from use of the website or products.

These limitations do not apply where liability cannot legally be excluded or limited, including for applicable statutory consumer rights.

We may update these Terms from time to time by posting the revised version on this page. Material changes take effect as required by applicable law. If any provision is found unenforceable, the remaining provisions continue in effect.

13. Governing law

These Terms are governed by the laws applicable where ImmaDaddy is established, without excluding any mandatory protections available to you in your place of residence.
